From Groklaw, I see Novell revenue going down over this as a large portion of Enterprise customers were choosing Novell to avoid MS bullshit. Is Your Linux Vendor bedding down with Microsoft?

A simple analogy. When you were using MSIE 6 browser during the recent patent cases were you sued by Microsoft? No of course not as users of patent infringing software cannot be sued and of course clean room reverse engineering is perfectly legal. MS ought to know part of this as they did in fact use clean room reverse engineering during the DOS wars and even received a court precedent on exactly that issue.

Hopefully, Sun avoids bedding down with Microsoft over this matter. However, SUN has been known to waiver in the face of money from MS.
