According to this iTnews article Eloas has 1998 patent on object/plugin embedding in a browser and won a judgment. However, what is on MS's Netscapes, Mozzilla's, and etc sides is the fact the Netscape first developed the same technology in 1994 and it was released to public in 1995 with both Spyglass and MS adopting the saem tehcnology in 1996-1997. Its suprising that Ms has not brought up the details of prior art yet in the trial or the appeal.

Of course in MSIE ther e re 2 ways to embed objects and I am referring to the way that uses the Netscape licensed plugin api. Eolas's patent may only refer to the other MS way of embedding objects; but still its technology that has prior art in the code MS added to the spyglass code base in 1994-1996 time frame.
